The state Court of Appeals indicated Tuesday it would not question a lower court’s decision allowing construction of a man-made park on the Hudson River in Manhattan partly funded by media mogul Barry Diller.

Without comment, the court denied an appeal of September’s ruling in City Club of New York v. Hudson River Park Trust, 2016-985 by the Appellate Division, First Department (NYLJ, Sept. 9).
