A judge used a “fair and reasonable interpretation” of the evidence in finding that the state was not civilly liable for the shooting of a man by a state trooper, a state appeals court found.

The Appellate Division, Third Department, panel ruled unanimously that its analysis of the evidence before state Court of Claims Judge Catherine Schaewe showed that the wounds suffered by Franller Villaneuva when he was shot three times by Trooper Michael Woytach in 2008 were not inconsistent with the officer’s version of events leading up to the shooting following a police chase near Binghamton.
