The question of whether a bail bond agent can keep the premium even though the criminal defendant was denied bond is headed for New York’s highest court.

Arthur Bogoraz was arrested in 2011 and indicted in Brooklyn for his alleged role in a multimillion-dollar insurance fraud. With bond set at $2 million, his friends and family contracted with Ira Judelson, a licensed bail bond agent affiliated with International Fidelity Insurance Co., paying Judelson a $120,560 premium on the bond.
