The shuttered Hudson River CafÉ and one of its owners cannot vacate their default judgment in a civil lawsuit based on the broad claim that their attorney missed a deadline after he became ill and died, an appeals court ruled Tuesday.

The Appellate Division, First Department, found the owners failed to specifically allege how their lawyer’s illness caused him to miss filing a response in the underlying case or to establish a valid defense in the suit.
