PEOPLE, ETC., res, v. DONALD MICHEL, ap — (IND. NO. 25/09)Appeal by the defendant from a judgment of the Supreme Court, Kings County (J. Goldberg, J.), rendered December 5, 2011, convicting him of murder in the second degree and criminal possession of a weapon in the second degree, upon a jury verdict, and sentencing him to an indeterminate term of imprisonment of 25 years to life on the conviction of murder in the second degree and a determinate term of imprisonment of 7 years plus 5 years of postrelease supervision on the conviction of criminal possession of a weapon in the second degree, to run consecutively to each other.

ORDERED that the judgment is modified, on the law, by providing that the sentence imposed on the conviction of murder in the second degree shall run concurrently with the sentence imposed on the conviction of criminal possession of a weapon in the second degree; as so modified, the judgment is affirmed.
