ESTATE OF LEA BONDI JARAY, Deceased (00/3223/A) — In this proceeding by an alleged creditor to compel an accounting by the ancillary administrator of the estate of Lea Bondi Jaray, respondent has moved for summary dismissal of the petition pursuant to CPLR 3212. For the reasons stated below, the motion is granted.

Decedent died in the United Kingdom on February 15, 1969. Decedent’s niece, Margerethe Fisher, was appointed administrator of her estate in the United Kingdom. When Margarethe died in 1991, her daughter, Edith Southwell, continued her mother’s effort to locate and retrieve a painting titled Portrait of Wally by Egon Schiele that decedent had owned, but had surrendered to the Nazis under duress in 1939.
