In a trademark dispute involving popular fragrance brands, a federal judge has sanctioned perfume company Excell Brands, represented by Blank Rome, for producing a witness who answered “I don’t know” nearly 40 times during a deposition.

Southern District Judge Jesse Furman on Friday called the witness “patently unprepared” and ordered Excell to reimburse its adversaries—owners of Calvin Klein and Vera Wang fragrance brands—their related attorney fees. Furman also ruled that Excell was precluded from presenting certain evidence at trial.
