ALBANY – A federal judge dismissed an unjust enrichment claim filed against the Aldi discount supermarket chain by a group of ex-store managers, who say they were denied overtime despite working 60 to 70 hours each week.

Northern District Judge Lawrence Kahn ruled Dec. 14 that the unjust enrichment claim under state law filed by three former managers is pre-empted by their allegation in Griffin v. Aldi, 5:16-cv-0354, that the supermarket chain, by not paying them overtime, also violated the federal Fair Labor Standards Act (FLSA).
