ESTATE OF HAROLD ANTIN, Deceased (02/0111) (02/0111) — This is a motion by the executor of the estate of Harold Antin to reargue and/or renew parts of this court's decision of April 5, 2016, which fixed legal fees for successive estate counsel (Matter of Antin, NYLJ, Apr. 11, 2016 at 21, col 4; 2016 NY Misc LEXIS 1119 and 2443). The decision resolved two separate proceedings: 1) SCPA §2110 proceeding commenced by executor's prior counsel; and 2) the executor's accounting, in which an application to fix legal fees was submitted following summary resolution or settlement of certain objections (Matter of Antin, NYLJ Feb. 1, 2013 at 22, col 4, 2013 NYLJ LEXIS 2260).

Specifically, the executor seeks leave to reargue and/or renew two aspects of the decision fixing legal fees: (1) the disallowance of approximately $20,000 paid by the executor to two separate law firms ($8,430 to one firm for litigation services and $10,759.76 to another firm for tax advice and consultation with the IRS); and (2) the court’s disallowance of $2,925 in unpaid legal fees charged by the executor’s current attorney for services rendered after the close of the accounting period. These sums were disallowed based on the absence of adequate documentation.
