A Manhattan federal judge has granted a preliminary injunction against Milton Tingling, New York County clerk, ordering him to immediately provide public access to newly filed civil complaints.

Courthouse News Service filed suit against Tingling last month, claiming newly filed complaints in Manhattan Supreme Court are being improperly withheld from the press and the public for days. Courthouse News sought a preliminary injunction to require Tingling to return to the “decades-long tradition” of timely access. The news service, represented by Bryan Cave senior counsel William Hibsher, said much of the delay is due to Tingling’s policy of not providing access to new complaints until after clerical processing—a series of tasks that concludes with an index number assignment.
