A lawsuit by one of the developers of the “Grand Theft Auto” video game series claiming millions of dollars in owed royalty payments will go on after a Manhattan judge partially denied a motion to dismiss this week.

Manhattan Commercial Division Justice Barry Ostrager allowed breach of contract and related claims to survive in a suit filed by Leslie Benzies in April. Ostrager dismissed other claims brought by Benzies, ruling they were duplicative and derivative of the breach of contract-focused claims. The judge denied a motion to stay the suit in favor of a similar federal suit that is narrower in scope.
