ALBANY – Reversing a lower court, the state Court of Appeals said a jury should decide whether an upstate dairy farm was negligent in a fatal motor vehicle accident involving one of its wayward calves.
The state’s highest court said summary judgment should not have been granted to the Drumm Family Farm in the case, Hain v. Jamison, 201, based on the number of events that occurred between the calf’s escape from the Drumm property and when Holly Hain was killed by another vehicle near the Steuben County farm on a night in February 2010.
