On Dec. 1, 2016, the Commission on Judicial Nomination recommended to the governor seven candidates to fill the vacancy that will be created by the retirement of Judge Eugene F. Pigott at the end of this year. Two of the candidates are current Appellate Division justices, one is general counsel to the New York County District Attorney’s Office, and four are in private practice—one of whom is a former Appellate Division justice. All seven candidates were determined to be well-qualified for the position by the commission. Governor Andrew Cuomo has until Jan. 15, 2017, in which to act on the commission’s recommendations and, given each candidate’s impressive record of public service, he will not have an easy decision.

We noted in last month’s column that Judge Pigott announced his intention to seek Office of Court Administration approval to remain as a certificated trial judge upon his retirement from the Court of Appeals. That request was recently approved, and Judge Pigott will serve as a Supreme Court trial judge in Buffalo for a two-year term. As we observed last month, Fourth Department justices will soon be in the odd position of reviewing decisions of a judge who has been reviewing their decisions for the past decade.
