A wealth management fund that invested $21.9 million in Lehman Brothers Finance AG just before its 2008 bankruptcy can move forward with a breach of contract claim against a separate bank assigned bankruptcy-claim rights.

Banc of America Credit Products allegedly refused to consent or take action to effect a $21 million and then $21.9 million settlement Lehman offered the fund between 2013 and 2014, triggering the suit.
