A Manhattan judge has denied a joint motion by defendants in asbestos litigation to exclude expert-witness testimony that the defendants say is based on a “single fiber” or “any exposure” approach to disease causation that many other jurisdictions around the country reject.

Manhattan Supreme Court Justice Peter Moulton ruled last week in Matter of New York City Asbestos Litigation, 190034/15, to deny defendants’ motion in limine to preclude expert testimony from Jacqueline Moline, an expert in occupational and environmental medicine who will testify that plaintiff Walter Andrews’ cumulative exposures to asbestos while working on the defendants’ products contributed to the development of his mesothelioma.
