Just days before the criminal retrial of two Dewey & LeBoeuf executives, prosecutors and defense attorneys continue to battle over upcoming testimony of a key government witness.
In early January, defense attorneys for former Dewey executive director Stephen DiCarmine and ex-CFO Joel Sanders asked Acting Supreme Court Justice Robert Stolz if they could cross-examine the firm’s former finance director, Francis Canellas, about the “complete circumstances” of his amended plea agreement. This includes, the defense said, the facts of the first trial “and the acquittals” (NYLJ, Jan. 5).
