Emails stored on a Microsoft server abroad remain beyond the grasp of U.S. law enforcement following the narrow defeat of the government’s motion for rehearing en banc Tuesday.
A split U.S. Court of Appeals for the Second Circuit denied rehearing a July decision the Justice Department says handicaps investigators by making it easier for criminals to move incriminating data outside their reach, and that Microsoft defended as a victory for privacy rights.
