The U.S. Court of Appeals for the Second Circuit has rejected rehearing en banc a challenge to a man’s conviction under the “omnibus clause” of the Internal Revenue Code.

The clause criminalizes any corrupt obstruction of, or impediment to, the administration of the code by such things as failing to maintain corporate books, shredding or destroying business records, and failing to give an accountant complete and accurate information.
