In an unusual move, a state appeals court granted Bronx District Attorney Darcel Clark’s motion for a writ of prohibition on a trial judge’s order to preclude evidence about a gun allegedly used in a robbery.

According to court papers, in 2015, Ronnell Joseph was accused of pointing a pistol at a longtime friend and robbing him of $8,300 worth of jewelry and cash. But Joseph testified before a grand jury that he did not have a gun nor display one on the day of the incident, and no gun or item appearing to be one was recovered.
