ESTATE OF JANET HALPER, Deceased (11/336) — The instant contested probate proceeding has been pending before this Court for over six years. The decedent, Janet Halper, died at 75 years of age on November 22,2010, survived by five adult children, namely Arnel Halper (the petitioner), Laura Simon, Darren Halper, Hal Halper and Jason Halper (the objectant). On January 28, 2011, the petitioner filed a petition to probate a written instrument dated June 9, 2006, which purports to be the decedent's last will and testament (the propounded instrument). Pursuant to Article SIXTH of the propounded instrument, the decedent specifically makes no provision for the objectant.

On March 8, 2011, verified objections to the instant probate petition were filed by the objectant, pursuant to which he asserts that the decedent was domiciled in Suffolk County,1 that the decedent lacked testamentary capacity at the time of execution of the propounded instrument, and that such instrument is a product of undue influence and/or fraud on the part of the petitioner and others.
