The Public Administrator stated on the record in open court that he consented to the issuance of letters limited solely to accept service of process in an underlying landlord and tenant proceeding without any obligation to defend. Accordingly, the matter was marked submitted.

Based upon this state of the record, the application is granted without opposition of the decedent’s distributees and letters of administration shall issue to the Public Administrator limited solely to accepting service of process in a landlord and tenant proceeding to be commenced in the Housing Court of the City of New York without any obligation of the Public Administrator to defend or file an answer in that proceeding.
