A man who had to have his testicle removed after he was struck in the groin by a golf club swung by the general manager of the country club where both worked may proceed with his liability suit, an appeals court decided Thursday.

William Montgomery is not precluded from pursuing his separate negligence suit against Richard Hackenburg, despite applying for and receiving workers’ compensation benefits as a result of his injuries at the Glens Falls Country Club in Warren County, the Appellate Division, Third Department, ruled.
