The public corruption conviction of former New York State Assembly Speaker and Democratic powerhouse Sheldon Silver will be tested on March 16 at the U.S. Court of Appeals for the Second Circuit.

Assistant U.S. Attorney Andrew Goldstein must fend off a challenge from Silver’s legal team over jury instructions on “official action.” Silver lawyers claim the instructions are invalid under the U.S. Supreme Court’s decision last year flipping the conviction of former Virginia Gov. Bob McDonnell in McDonnell v. United States, 15-474.
