ESTATE OF ARTHUR MUSIELLO, Deceased (16/800) — This is a proceeding to probate, as an ancient document, an instrument dated November 21, 1969. The testator died on January 21, 2014. The decedent’s distributees are a spouse and two daughters, one of whom is the proponent/nominated successor executor, and each of whom is a one-third beneficiary under the instrument. The spouse, who is the nominated executor, filed a renunciation and a waiver and consent to the application, and the remaining daughter also consents to probate.

The three-page will, which is regular on its face, is signed by the decedent, was witnessed by two witnesses and contains an attestation clause. One of the two witnesses, the drafting/supervising attorney, is deceased, and the whereabouts of the other witness, believed to have been the legal secretary to that attorney, are unknown. Following the decedent’s death, the will was found in an unaltered form at the decedent’s residence in its original envelope.
