ESTATE OF MARGARITA CASADO, Deceased (12/775/A) — The administrator, one of the decedent’s daughters, seeks to remove the restrictions on her limited letters of administration so that she may receive and judicially account for the settlement proceeds of a personal injury cause of action.

The decedent allegedly sustained personal injuries in two separate falls while a nursing home resident and died intestate on February 17, 2009, of unrelated causes. In addition to the petitioner, the decedent’s distributees are another daughter and five sons, two of whom post deceased. Although no fiduciary has been appointed for the estate of one of the post-deceased sons, two of his children, his alleged only distributees, consent to the application. The other distributees, including the voluntary administrator of the estate of the other postdeceased son, and the New York State Department of Taxation and Finance also consent to the relief requested.
