ESTATE OF DOROTHY CLAYTON, ALSO KNOWN AS DOROTHY LEE CLAYTON, Deceased (09/2100/A) — The administrator, one of the decedent’s daughters, seeks to remove the restrictions on her limited letters of administration so that she may receive and judicially account for the proceeds of settlement of a personal injury cause of action.

The decedent sustained injuries in a fall on April 22, 2008 and died intestate on May 19, 2009, of unrelated causes. In addition to the petitioner, the decedent’s distributees are six other children, one of whom is a son under a disability who allegedly executed a power of attorney while competent in favor of his spouse. The guardian ad litem appointed for the son under a disability recommends approval of the application except for certain funeral expenses for which the petitioner seeks reimbursement. The five other children and the New York State Department of Taxation and Finance consent to the application.
