Setting the stage for a second trial, the Court of Appeals on Thursday refused to weigh in on a prosecutor’s challenge to a ruling that overturned the conviction of a Washington County man for killing his mother, stepfather and stepbrother.

The court said in People v. Slocum, 17, that it lacked jurisdiction to consider the mixed question of law and fact presented by whether Matthew Slocum’s right to counsel had been violated during a police interrogation. The interview was conducted after a public defender notified prosecutors that he had represented Slocum during a previous case and that he should not be questioned.
