ESTATE OF MURIEL STUART, Deceased (08/1017) — This matter was last on the court calendar of March 7, 2017. After a lengthy conference, a tentative partial agreement was reached by the parties in order to show good faith and effectuate an eventual global settlement of this eight year old matter. However, after the conclusion of the conference and within a 24 hour period, the acrimony between the parties started yet again and all progress made at the conference quickly unraveled. Therefore, the Court is once again left with a matter that is unresolved, because the disagreements between the parties are so deep rooted that no time allotted for conferencing will suffice to solve their issues.

Therefore, the parties are given one last opportunity to work out amongst themselves an agreement regarding the sale of the real properties held by the trust and whether any partial distribution is to be made to the beneficiaries. The failure to reach an agreement will only propel the Court to move forward with the current petition filed on or about July of 2016 by Shari Weber. Therefore, this matter is scheduled for Wednesday April 5, 2017 at 9:30 am. At that time, counsel are to appear and report as to whether an agreement has been reached by the parties regarding the above mentioned disputes, or in the alternative, to provide a discovery scheduled for the petition before the court, which will result in a hearing before the Surrogate.
