ESTATE OF CONNIE ALINI, Deceased (13/1273) — In this contested probate proceeding, the objectants to an instrument purporting to be decedent's last will and testament, move for summary judgment dismissing the petition for probate filed by Ralph Alini, decedent's son, based on duress. The proponent of the will cross moves to deny the objectant's summary judgment motion and grant petitioner's probate petition in as much as the decedent's last will and testament is valid on its face. Although a summary judgment motion was made in early 2016, none of the parties argued the issue of duress, which will be the sole focus of the decision herein.
