An appeals court has vacated a stay that had allowed New York state to continue withholding $69 million in aid to 19 troubled schools that are seeking to exit state designation as “persistently struggling” institutions.
The Appellate Division, Third Department, panel also said in its order from Albany in Matter of Cortes v. Mujica, 524614, that it has granted expedited treatment to the underlying case and will hear oral arguments in its May term.
