A federal judge has cleared the way for a trial over a former inmate’s claims that the state Parole Board unfairly reneged on releasing the convicted cop killer in 1999 due to political pressures from then Gov. George Pataki’s office.
Western District Judge William Skretny ruled in Victory v. Grant, 02-CV-31S, that enough triable issues exist about the actions of the officials to deny them summary judgment, based on their claimed entitlement to absolute or qualified immunity. Skretny ordered the parties to return to his Buffalo courtroom on May 31 to set a trial date.
