A trial judge erred by not insisting that a defendant who engaged in several “inappropriate outbursts” in court undergo a psychiatric evaluation, an appeals court ruled in ordering a new trial for the man.

The Appellate Division, Fourth Department, panel ruled unanimously that James Minckler’s behavior raised enough doubts about his mental competency to have compelled the judge, Acting Oswego County Court Judge James Metcalf, to order a mental fitness evaluation for the defendant under Criminal Procedure Law Article 730 at his 2014 trial for burglary.
