ESTATE OF OSCAR A. TOLOZA, JR., A/K/A OSCAR ALEJANDRO MEDRANO TOLOZA, JR., Deceased (13/189/A) — This is an application to settle and compromise a wrongful death action, to settle the account and for a determination that the decedent’s father is not entitled to share in the proceeds of the settlement because he abandoned the decedent (EPTL 4-1.4).

The decedent’s alleged putative father, Oscar A. Toloza, Sr., was served by publication of a Citation containing all the specific relief being sought. The Guardian ad Litem, appointed on his behalf, has filed his report and no opposition to the requested relief has been filed. The fee of the Guardian ad Litem is fixed at $2,250.00, and shall be paid within thirty (30) days of the date of this decision.
