CHRISTOPHER COLLINS, ETC. res — (INDEX NO. 10692/14)In a proceeding pursuant to CPLR article 78 to review a determination of the Board of Standards and Appeals of the City of New York dated June 24, 2014, which, after a hearing, denied the petitioner's appeal from a determination of the Department of Buildings of the City of New York dated January 14, 2014, denying its application for a finding that the portion of the subject building located in a C4-2 zoning district is not subject to regulation under New York City Zoning Resolution §113-11, the petitioner appeals from a judgment of the Supreme Court, Kings County (Solomon, J.), dated January 15, 2015, which denied the petition and, in effect, dismissed the proceeding.
