PEOPLE, ETC., res, v. AARON D. SUTTON, ap — (IND. NO. 2636/12)Appeal by the defendant from a judgment of the Supreme Court, Queens County (Margulis, J.), rendered December 3, 2014, convicting him of burglary in the second degree, attempted burglary in the second degree, and criminal facilitation in the fourth degree, upon a jury verdict, and sentencing him to consecutive determinate terms of imprisonment of 10 years plus 5 years of postrelease supervision on the conviction of burglary in the second degree and 5 years plus 5 years of postrelease supervision on the conviction of attempted burglary in the second degree, and a definite term of imprisonment of 1 year on the conviction of criminal facilitation in the fourth degree, to run concurrently with the consecutively imposed sentences.

ORDERED that the judgment is modified, as a matter of discretion in the interest of justice, by providing that all of the sentences imposed shall run concurrently with each other; as so modified, the judgment is affirmed.
