ESTATE OF MARIE PEPE, Deceased (16/2139) — In this probate proceeding, objections were filed by three of the decedent’s four sons, her only distributees and equal beneficiaries under the propounded instrument dated May 5, 1993; however, the objections relate only to the appointment of the other son who is the nominated executor, and instead, they request the appointment of the successor executor, one of the other three sons, in his place.

As no SCPA 1411 citation is required because the objections do not relate to probate and only to the appointment of the nominated executor, the matter will appear on the settlement conference calendar of the court at 9:30 a.m. on Tuesday, September 12, 2017 in courtroom 406. All counsel, and any party who wishes to do so, are to appear ready to discuss the underlying issues, possible settlement or schedule disclosure.
