ESTATE OF JAMIE MORALES, Deceased (16/2795) — On the return date of the supplemental citation in this previously contested application by the decedent’s father for limited letters of administration to himself and the decedent’s sister as a designee, the decedent’s mother, her only other distributee, who is alleged to be under a disability was cited and defaulted. If the mother’s disability caused her default, it appears she would be ineligible to serve as the fiduciary of the estate. Consequently, no guardian ad litem shall be appointed for her in this proceeding; however, if appropriate, a guardian ad litem will be appointed for that daughter in any future accounting or other appropriate proceeding.

The decedent’s sister agreed to withdraw her objections and consented to the application as amended. Accordingly, the objections are marked “withdrawn” and in the absence of any opposition the application is granted. Limited letters of administration subject to the provisions of SCPA 702 (1) with regard to any cause of action may issue to the father and the sister.
