ESTATE OF CEPHEIN EUNICE SHARPE, ALSO KNOWN AS CEPHELIN SHARPE, Deceased (17/568) — This is a proceeding by an attorney who is the designee of the decedent’s daughter and son-in-law, the nominated co-executors appointed in the United Kingdom, for ancillary probate of the decedent’s will dated May 10, 2010, which was admitted to probate by the High Court of Justice, Family Division, United Kingdom, England, the decedent’s alleged domicile, and for the issuance of ancillary letters of administration c.t.a. The New York State Department of Taxation and Finance consents to the relief requested in accordance with the terms of a filed written stipulation.

It appears that the decedent possessed an interest in real property located in New York State which requires administration. Accordingly, the will is entitled to be admitted to ancillary probate (SCPA 1602), and ancillary letters of administration c.t.a. shall issue to the petitioner (SCPA 1604 [1] [b]). The letters shall be subject to the provisions of SCPA 805 (3) with regard to the disposition of any real property.
