M., AN SCPA 17-A PERSON (14/1853/C) — This is an uncontested miscellaneous proceeding by the aunt and guardian of the person and property of the respondent Desha L. M., who was determined to be an intellectually disabled person by decree of this court dated March 16, 2015, as amended by orders dated May 21, 2015 and March 29, 2016, seeking leave to establish and fund a third-party supplemental needs trust (SNT) for the benefit of the respondent and for an award of attorney's fees and disbursements in bringing this application.

M., AN SCPA 17-A PERSON (14/1853/C) — This is an uncontested miscellaneous proceeding by the aunt and guardian of the person and property of the respondent Desha L. M., who was determined to be an intellectually disabled person by decree of this court dated March 16, 2015, as amended by orders dated May 21, 2015 and March 29, 2016, seeking leave to establish and fund a third-party supplemental needs trust (SNT) for the benefit of the respondent and for an award of attorney’s fees and disbursements in bringing this application.

Jurisdiction was obtained over the respondent, the New York State Office for People with Developmental Disabilities, the New York State Attorney General, and the New York City Human Resources Administration, without opposition. Pursuant to the proposed SNT, an executed copy of which is annexed to the application, the petitioner would serve as trustee of the SNT which is to be funded with the proceeds of the estates of the respondent’s parents who died intestate in Georgia. Currently, those proceeds are held in a guardianship account by the petitioner as guardian, jointly with the Guardianship Clerk of this court.
