ESTATE OF UMARNAUTH SOMAI, Deceased (16/2203/A) — In this estate, an application was filed by an alleged creditor seeking the issuance of limited letters of administration to the Public Administrator, and the decedent's spouse filed a cross petition seeking the issuance of letters of administration to herself. The alleged creditor's application was adjourned to May 23, 2017 to be withdrawn without any further appearance being necessary provided letters of administration issue to the spouse prior to that adjourned date. The decedent's remaining distributees are a daughter, who consents to the spouse's application, and a post deceased son, who is survived by an infant daughter. No fiduciary has been appointed in the estate of the post deceased son.

The decedent’s remaining distributees are a daughter, who consents to the spouse’s application, and a post deceased son, who is survived by an infant daughter. No fiduciary has been appointed in the estate of the post deceased son.

Accordingly, the spouse’s application is granted and letters of administration shall issue to her upon the filing of a bond in the penal sum of $35,000, and shall be subject to the provisions of SCPA 805 (3). The application of the alleged creditor shall be marked “withdrawn” at the call of the calendar of May 23, 2017. The spouse shall mail a copy of the decree to be entered hereon upon the alleged creditor and the Public Administrator.
