ESTATE OF INOCENCIA FIGUEROA, ALSO KNOWN AS INOCENSIA FIGUEROA, Deceased (15/2577/C) — In this contested estate, the decedent's son originally filed for limited letters of administration and the decedent's spouse filed a cross petition also seeking letters of administration. The spouse's cross petition was granted, and a decree was entered on March 13, 2017 directing the issuance of letters upon the spouse's filing a bond in the penal sum of $41,000. Thereafter the son filed a motion seeking to restore the matter to calendar and vacate the decree based upon the spouse's failure to file the bond. The spouse crossmoved for sanctions and attorney fees.

Annexed to the moving papers are several e-mail requests from the son’s counsel to the spouse’s attorney requesting that a bond be filed, which apparently were not answered. On the return date of the motion, the spouse filed the required bond. As letters have now issued, the son’s application is rendered academic and the cross motion is denied in all respects.
