ESTATE OF FRANCISCO SANCHEZMIRANDA, Deceased (15/2750/A) — The co-administrators, the decedent’s mother and her designee, seek to lift the restrictions on their limited letters of administration in order to distribute and judicially account for the remaining proceeds of a personal injury action settled in the Supreme Court, Bronx County (McKeon J.), which are being held in their counsel’s escrow account. The supreme court order, inter alia, directed the payment of counsel fees and disbursements, and a Medicaid lien.

The infant decedent sustained injuries from alleged medical malpractice which occurred during childbirth and an aftercare, and died on September 2, 2015 at the age of six years. In addition to the co-petitioning mother, the decedent’s only other distributee is his father. The decedent’s father and the New York State Department of Taxation and Finance consent to the application. Counsel is allowed an additional disbursement of $375 in reimbursement of a filing fee. The net distributable proceeds are to be paid to the decedent’s parents in equal shares pursuant to EPTL 4-1.1.
