ESTATE OF GUY CHADBOURNE. Deceased (16/214) — In this proceeding by the proponent, an attorney, seeking to probate an instrument dated August 1, 2015, jurisdiction was obtained over all necessary parties, two relatives of the decedent’s predeceased spouse filed objections, one of the decedent’s nieces intermittently appeared pro se and the decedent’s other distributees defaulted. On the return date of a SCPA 1411 citation, the parties and the niece appeared. After a conference with a member of the court’s law department, the objectants, the proponent and the sole testamentary beneficiary executed a written stipulation which was “so-ordered” by the court, and those parties and the niece entered into another stipulation on the record in open court pursuant to which, inter alia, the objections were withdrawn and the matter was to proceed as an uncontested matter subject to the terms of those stipulations.

As no acknowledgment of disclosure document was filed, the commissions of the attorney-executor are limited pursuant to SCPA 2307-a (1) (c) to one-half the statutory commissions to which he would otherwise be entitled (see Matter of Fullen, NYLJ, Nov. 26, 2007 at 32, col 1 [Sur Ct, Westchester County 2007]; Matter of Tackley, 13 Misc 3d 818 [Sur Ct., New York County 2006]).
