ESTATE OF FALLOU DIBA, Deceased (97/A/642A-B and 07219M) — This is an uncontested proceeding by the petitioners, two infant children and distributees of the decedent who reside in Senegal and recently attained majority, seeking to withdraw funds deposited with the Commissioner of Finance of the City of New York (the Commissioner) for their benefit pursuant to a decree dated July 8, 2010. That decree directed that their distributive shares of the net distributable settlement proceeds of causes of action arising from the decedent's death were to be paid to the duly appointed guardian of each former infant's property jointly with the Guardian Clerk of this court and if no guardian was appointed within 60 days after entry of that decree, those funds were to be turned over to the Commissioner to be held until further order of this court. Jurisdiction was obtained over the Public Administrator and the Commissioner, without opposition.

Based on the proof submitted, the court is satisfied that the petitioners, Khadime Diba and Sokhma Mai Diba, are now over the age of 18. Accordingly, the Commissioner is directed to pay the balance of the funds on deposit for the benefit of the petitioners in the manner requested.
