GUARDIANSHIP OF NILDA T. O. T. PURSUANT TO SCPA ARTICLE 17-A (05/A/238G) — In this application, the respondent's brother seeks his appointment as successor guardian of the respondent's person and the appointment of another brother as successor standby guardian. By decree dated April 10, 2006, the court appointed the respondent's mother, Juanita O., guardian of the person of the respondent; a sister, Juanita O., as standby guardian; the petitioner, as alternate standby guardian; and, another brother, Rafael H. O., as second alternate standby guardian. The mother and the sister now seek to resign and consent to the application, and a consent was also filed for a third brother, Jose O.

By decree dated April 10, 2006, the court appointed the respondent’s mother, Juanita O., guardian of the person of the respondent; a sister, Juanita O., as standby guardian; the petitioner, as alternate standby guardian; and, another brother, Rafael H. O., as second alternate standby guardian. The mother and the sister now seek to resign and consent to the application, and a consent was also filed for a third brother, Jose O.

As it appears to be in the best interests of the respondent, the application is granted. Accordingly, the respondent’s brother, Juan R. O., is application is granted. Accordingly, the respondent’s brother, Juan R. O., is appointed the successor guardian of the person of the respondent and another brother, Rafael H. O., is appointed successor standby guardian to serve when the primary successor guardian is no able to do so. The successor standby guardian shall assume the duties of his office subject to qualification and confirmation pursuant to SCPA 1757.
