ESTATE OF RUTH MAYS, Deceased (14/2578) — This is an application by an alleged creditor seeking the issuance of limited letters of administration to any eligible distributee, or upon their default, to the Public Administrator, and to dispense with the service of process on three of the six alleged distributees, whose whereabouts are unknown. After jurisdiction was complete over the three other alleged distributees, without opposition, and after the Public Administrator indicated on the record in open court that she consented to receive letters, the alleged creditor and the Public Administrator filed a written stipulation providing that "full" letters of administration may issue to the Public Administrator.

Accordingly, based upon this state of the record, the court dispenses with the service of process on the three whereabouts unknown alleged distributees in this proceeding provided that jurisdiction is obtained over them in the accounting or other appropriate proceeding (see SCPA 1003 [4]), and the application, as amended by the stipulation, is granted. Letters of administration may issue to the Public Administrator upon duly qualifying according to law.
