ESTATE OF ELINA GUTIERREZ, Deceased (16/288/A) — The administrator, one of the decedent’s daughters, seeks to remove the restrictions on her limited letters of administration so that she may receive and distribute the proceeds of a personal injury cause of action.

The decedent sustained injuries allegedly when she tripped and fell exiting an elevator on September 2, 2014 and died intestate on November 25, 2015, of unrelated causes. In addition to the petitioner, the decedent’s only other distributee is another daughter who was cited and defaulted. CMS/Medicare and Medicaid Services was served with citation seeking to pay its claim, and it defaulted. The New York State Department of Taxation and Finance was also cited, and it defaulted.
