ESTATE OF CLEOPHIS MCFADDEN, Deceased (16/797/A) — On the initial return date of this application by a creditor of the decedent seeking the issuance of letters of administration to the Public Administrator limited solely to defending a pending action, it appeared that jurisdiction was incomplete over the decedent's son and daughter, his only alleged distributees, as well as over the Public Administrator, notwithstanding that the son appeared pro se on that date. On the return date of supplemental citation over all parties, it appeared that jurisdiction was complete, there as no appearance by the son and daughter, and the Public Administrator appeared and agreed to accept letters limited to accepting service in the pending action, without any duty to defend.

Accordingly, and in the absence of any opposition, the application is granted and letters of administration shall issue to the Public Administrator, limited in the manner requested. Notwithstanding the default of the two alleged children, a copy of this decision and the decree to be entered hereon shall be settled upon them.
