ESTATE OF CARLSON H. BYRON, Deceased.1 (16/216/B) — In this uncontested proceeding pursuant to SCPA §2110, Stuart Salles, Esq. (the petitioner) seeks an order of the court fixing and determining legal fees and permitting him to file a lis pendens on real property.

On January 13, 2016, Carlson H. Byron (the decedent) died, survived by a son, Carlson H. Byron, Jr. (Byron), who is a resident of the Commonwealth of Virginia. By retainer, dated February 29, 2016, Byron executed an agreement with the petitioner, an attorney, pursuant to which he agreed that the petitioner’s legal fee would be calculated as five percent (5 percent) of the gross estate. The sole asset of the estate is the decedent’s real property located at 13 Decatur Street in Brooklyn, New York (the real property), which the petitioner estimates to be valued at $1,400,000.00. Letters Testamentary were issued to Byron on March 23, 2016.
