*1 Motion by plaintiff East Ramapo Central School District for summary judgment is granted to the extent indicated below. Motion by plaintiff to strike the affidavit and report of James Ryan, submitted in opposition to plaintiff’s motion for summary judgment is denied.This is an action to recover legal expenses covered by a school board legal liability policy. The matter is before the court pursuant to a remand from the Appellate Division, (Central School District v. NYSIR, 150 AD3d 683 [2d Dept. 2017]).
